Is Musk’s DOGE Dodging the Law?

Is Elon Musk’s Department of Government Efficiency (DOGE) dodging the law? The nonpartisan program Open to Debate recently took on the question. Stanford Law School Professor Michael McConnell argued “no.” According to McConnell, a former federal judge and constitutional law expert, DOGE might be controversial, but it operates within its legal mandate to enhance government efficiency. Concerns about conflicts of interest are speculative, he contended, and DOGE’s initiatives align with the administration’s goals to improve governmental operations. Harvard Law School Professor Laurence Tribe argued “yes,” saying DOGE undermines the separation of powers and bypasses legislative oversight. Tribe emphasized that DOGE’s actions could erode democratic accountability.

Open to Debate, a nonpartisan, debate-driven media organization, seeks to counteract the extreme polarization of American politics. It is “dedicated to bringing multiple viewpoints together for a constructive, balanced, respectful exchange of ideas.”
